Terms and Conditions of Sale apply to any purchase made by an Internet user / natural or legal person (hereinafter the "CUSTOMER") on the online store : https://pro.cousubio.com and its variations (hereinafter the "WEBSITE"), from the company Cousu Bio SARL, Limited Liability Company with a capital of 11 000 euros, registerede under number 840 212 781 00016, whose headquarters are located at Le Bourg, 23150 MAZEIRAT, registered with the RCS of Guéret 840 212 781, VAT number FR41840 212 781. E-mail: bonjour@@cousubio.com (hereinafter the "SELLER").

Article 1 - Purpose

The present conditions govern the sales by the company Cousu Bio, 23150 MAZEIRAT of ecological haberdashery supplies.

Article 2 - Products and Prices

The prices of our products are indicated in euros excluding taxes, unless otherwise indicated and excluding processing and shipping costs.

In case of an order to a country other than metropolitan France you are the importer of the product or products concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not within the competence of the company CousuBio. They will be at your charge and are your responsibility, both in terms of declarations and payments to the authorities and competent bodies in your country. We advise you to inquire about these aspects with your local authorities.

Allorders regardless of their origin are payable in Euros.

Thecompany Cousu Bio reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of validation of the order and subject to availability.

Theproducts remain the property of the company Cousu Bio until full payment of the price.

Caution: as soon as you take physical possession of the ordered products, the risks of loss or damage of the products are transferred to you.

Article 3 - Orders

You can place an order:

The contractual information is presented in French and will be confirmed at the latest at the time of validation of your order.

Thecompany Cousu Bio reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in case of supply problem, or in case of difficulty concerning the order received.

Article 4 - Validation of your order

Any order appearing on the website http://pro.cousubio.com assumes adherence to these General Conditions. Any confirmation of order implies your full and complete adherence to these General Terms and Conditions of Sale, without exception or reservation.

All data provided and the recorded confirmation will be worth proof of the transaction.

Youdeclare that you have full knowledge of them.

The payment of the order will be worth signature and acceptance of the operations carried out, as well as all the products and their quantities determined in the CUSTOMER's basket on the SITE.

A summary of the information of your order will be communicated to you via the e-mail address of confirmation of your order.

The minimumorder on the pro area is 130 euros excluding VAT

How to order?

- The products of your choice are added to the basket, you check the quantities.

- Check or change your delivery address.

- Your package will be delivered by GLS to your home (possibility to modify the shipping terms once the order is sente)

- The estimated price is displayed, you click on "Confirm order - I acknowledge that I have the obligation to pay".

- We check your order and available stocks. We adjust your order if necessary (downwards or very slightly upwards in case of end of roll)

- We edit your invoice which is sentto you by email.

- Once you have received your invoice , you can proceed to the payment of your order, bybank transfer according to the RIB provided on the invoice.

- Once payment is received, your order is shipped!

Article 5 - Payment

The fact of validating your order implies for the CUSTOMER the obligation to pay the price indicated.

The payment of your purchases is made by bank transfer to the details mentioned on the CLIENT's invoice.

In case of payment by bank transfer, the items are reserved for the CUSTOMER for a period of 7 working days. After this period and without receipt of payment, the products are released for sale.

Thearticles are not shipped until the total payment has been received by Cousu Bio.

Article 6 - Withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay any penalty.

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be of a nature to defeat the right of withdrawal.

EXCEPTIONS TO THE RIGHT OF RETRACTATION

In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

• The supply of services fully executed before the end of the period of retractation period and the performance of which has begun after the consumer has given his express prior consent and expressly waived his right of withdrawal.*
• The supply of goods or services whose price depends on fluctuations in the financial market beyond the trader's control and which may occur during the withdrawal period.
• The supply of goods made to the consumer's specifications or clearly personalised.**
• The supply of goods likely to deteriorate or expire rapidly.
• The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
• The supply of goods which, after delivery and by their nature, are inseparably mixed with other items ;

*Any product that has been cut, used, washed cannot be returned. NO REFUND OR EXCHANGE CAN BE MADE IN THIS CASE.

Beforeany return, the CUSTOMER shall inform the SELLER by e-mail at bonjour@@cousubio.com of his wish for a refund/exchange, specifying the order reference, the references of the products to be returned and the yardage if applicable.

The return of the product(s) must be made by trackedshipment with proof of deposit in COLISSIMO (La Poste) or GLS.

Thereturn costs are the responsibility of the CUSTOMER.

In case of exercising the right of withdrawal, the company Cousu Bio will proceed to the reimbursement of the sums paid, withina delai of 14 days following the reception of the returned products (proof of date Colissimo or GLS being proof) and via the same means of payment as the one used during the order.

Any request for reimbursement will not be made in the event of failure to comply with one of the conditions cited above.

Article 7- Availability

Our products are offered as long as they are visible on the website https://pro.cousubio.com and within the limits of available stocks. For products not in stock, our offers are valid subject to availability from our suppliers. In case of unavailability of product after placing your order, we will inform you by mail.Your order can be brought, with your agreement, to be modified or refunded.

Article 8 - Delivery

Theproducts are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page. The times indicated are estimated and provided by the carriers.

TheCUSTOMER is responsible for tracking their package via the GLS tracking link.

In case of deliveries by a carrier, the company Cousu Bio can not be held responsible for late delivery due exclusively to unavailability of the customer after several proposals for appointments.

Carriers:

• GLS FRANCE: delivery time 24/48H for metropolitan France.
• Preparation and shipping time at Cousu Bio: between 1 and 5 days.

In the event of a damaged package report:

• If the CUSTOMER is in the presence of the delivery person at the time of delivery, theCUSTOMER must take a picture of the damaged package and refuse it.
• If the CUSTOMER is no longer in the presence of the delivery person and the products insideIf the CUSTOMER is no longer in the presence of the delivery person and the products inside the package have been damaged, the CUSTOMER must take several photos of the damaged package and send a claim by e-mail to bonjour@@cousubio.com with the photos attached specifying his order reference, within72H following the delivery of the package (the GLS tracking receipt being proof). After this period, no claim of damaged package can be made.

Article 9 - Warranty

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided by Articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned, exchanged or refunded.

• Claims related to one or more productsmissing from your order: the CUSTOMER may send a claim by e-mail to bonjour@@cousubio.com within72H following the delivery of the parcel (date of proof of GLS tracking as proof). After this period, no claim of missing product can be made.

All Cousu Bio orders are photographed and dated before shipping.

• Complaints, requests for exchange or refund related to product nonconformity/incorrect measurement must be made by email within 30 days of delivery by email to bonjour@@cousubio.com. Products must be returned to us inthe condition in which you received them (uncut, unwashed, unused) with all the elements (accessories, packaging, instructions...). In case of return of the product that would not be in the original condition, no refund can be requested. Requests for incorrect yardage will not be considered if the product has been washed or used.
  
  

Theprovisions of this Article do not prevent you from benefiting from the right of withdrawal provided in Article 6.

Article 10 - Responsibility

The products offered are in accordance with the French legislation in force. The responsibility of the company Cousu Bio cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you plan to order.

Furthermore, the company Cousu Bio cannot be held responsible for damages resulting from a misuse of the purchased product.

Finally, the responsibility of the company Cousu Bio cannot be held liable for all inconveniences or damages inherent to the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

Article 11 - Applicable law in case of disputes

The present conditions of sale are subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.

Article 12 - Intellectual Property

All elements of the website https://pro.cousubio.com are and remain the exclusive intellectual property of the company Cousu Bio. No one is allowed to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound.

Hypertextlinks are allowed as long as the source and description of the source content are clearly stated and identified by the author.

Article 13 - Personal data

The company Cousu Bio reserves the right to collect nominative information and personal data about you. They are necessary to manage your order, as well as to improve the services and information we send you.

They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the law of January 6, 1978, you have the right to access, rectify and object to nominative information and personal data concerning you, directly on the website.

Article 14 - Archiving Proof

The company Cousu Bio will archive the order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

The computerized registers of the company Cousu Bio will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
